我國已於2018年步入高齡社會，高齡者財產管理議題益顯重要，於高齡者喪失意思能力時，如何運用法律制度保障高齡者之財產不受侵害，尊重高齡者本人之意思運用財產，及是否能於高齡者喪失意思能力前，讓本人選定信任之監護人，降低監護人侵害之可能，並賦予高齡者利用信託制度，預先規劃財產分配，誠值思考。我國於2019年引進成年人之意定監護制度，尊重本人之意願自行決定信賴之監護人選，其於財產管理之彈性化在於得特別約定監護人不受民法第1101條第2項及第3項之限制，且有簡易認定受監護人最佳利益之優點，受監護人得於未喪失意思能力前，透過決定與何人訂立意定監護契約之方式表達自己之意見，並可斟酌複數監護人間合作或監督
