電子競技選手法律地位與勞動權益之研究

電子競技是近年來席捲全球之熱門產業，我國躬逢其盛，不但為電子競技賽事創造可觀的收視流量，亦誕生不少揚名國際之選手，然而，伴隨此一百億產業而生的，卻是各式各樣的契約糾紛、裁罰爭議與過勞工作之疑慮。本論文嘗試由電子競技活動基本面上探討此領域紛爭不斷之根本原因，由於當前主流電子競技遊戲開發商皆為美國公司，本文參考美國文獻，分析電子競技產業之流變及組織結構，進一步定性電子競技選手之工作契約，釐清選手與其雇主乃至於電子競技聯盟間之權利義務關係。此外，電子競技雖自詡為運動，我國亦於2007年將其納入運動產業發展條例，但電子競技聯盟與傳統職業運動聯盟恐難簡單類比，畢竟在遊戲開發商手握智慧財產權之情況下，其

產業權力結構大幅朝資方傾斜，嚴重壓縮電子競技選手之協商地位，選手們往往僅能被迫接受不甚理想之勞動條件，不少學者因而紛紛呼籲電子競技選手仿效傳統運動員組成工會，只不過，電子競技產業之特殊性又爲此一選項創造更多障礙。另一方面，由於我國勞動基準法排除適用職業運動員，使臺灣電子競技選手面臨更加不利之勞動處境，既缺乏傳統職業運動聯盟之團體協商，又無最低勞動條件之保護，不難想像其血汗過勞之惡名從何而來。有鑑於此，本文參酌英美法規文獻，分析電子競技管理方法之利弊，為我國電子競技選手之勞動法規提出建議。
