隨著工業設計產業蓬勃發展,工業產品不再只重視其功能性,更注重其外觀設計。伴隨於此,專利客體亦由專利產品整體外觀,擴及至各部零件之設計。汽車作為日常生活常見的複合式產品,其維修利益龐大,故車廠傾向選擇就汽車之外觀零組件申請專利,除能排除其他競爭者外,亦能鞏固其於售後維修服務市場之地位,使消費者進行維修時僅能使用自家產品,賺取更多利益。我國汽車零組件產業多半從事售後維修服務市場,並於全球零組件市場中獨占鰲頭,年產值驚人。然,我國廠商帝寶公司就車燈產品被提起專利侵權訴訟後,引發國內相關產業恐慌,使我國開始探討設計專利適用維修免責條款之可能,希冀能對於設計專利為限制,保護國內產業以及保障消費者維修權

益。專利法賦予專利權人製造、販賣、使用等行為的排他權,為衡平公益及私益,有諸多就專利權限制的規定。美國法上維修與重建原則認為,若該修理行為屬於維修,為可允許維修;若該修理行為屬於重建,則為法所不允許,構成侵權。如何界定維修與重建之範圍,從而認定其行為的合法性至關重要。不僅我國探討維修免責條款,而欲於專利法中增訂第136條第3項,世界各國亦重視汽車外觀設計的維修議題,部分國家已通過維修免責相關法案。美國作為汽車生產大國之一,於西元2008年起相繼提出限制汽車外觀設計專利的零件法案,惟顧及國內產業利益考量均未通過。作為我國汽車零組件最主要之出口國且其專利法與我國相類,零件法案似能做為我國日後修法時

得參酌之規定。另外,導入維修免責條款影響過大,本文認為比起增訂維修免責條款,使設計專利得適用強制授權較能平衡專利權人保護及消費者權益,且為解決原廠有長期不製造或供不應求的情形,似可考慮恢復舊法第67條及68條未實施及未正當實施之規定。除能保障消費者維修權益,亦能避免單一立法之嫌並得適用於所有複合式產品。

本研究以台灣證劵市場之新聞報導、股價報酬和市場情續觀察投資人在信息和環境變動的情況下對股價報酬的反應,結合芝加哥選擇權交易所(CBOE)建立之恐慌指數(VIX)作為投資人情緒,探討在市場恐慌時期,投資人是否會因新聞報導引起對股價的不對稱反應,以及新聞報導是否會因投資人情緒對股價產生增額或減額效果。本研究以文字探勘(text mining)之支援向量機(SVM)作為機器學習的演算法,採用台灣經濟新報(TEJ)上市金融市場大事記資料庫之台灣50成分股的新聞報導和股價作為訓練樣本,研究樣本分成兩部份:(一) 2009至2016年之境內、外公司之新聞報導;(二)2011至2020年之新聞報導觀察恐

慌指數變動對股價報酬之反應。研究結果發現境內和境外公司具有資訊不對稱之反應:新聞報導的發佈對事件超額報酬率具顯著相關,但在恐慌指數變動則為不相關;同時延長對新聞報導的觀察,以事件累積超額報酬發現恐慌指數變動下,正、負面新聞具有不對稱的股價反應。
