本文聚焦於歐盟競爭法下之忠誠折扣，試圖藉由歐盟之經驗向競爭主管機關、法院與事業（尤其是獨占事業）提供建議。忠誠折扣乃附條件折扣之一種，其目的在於誘導需求方對己身之忠誠，進而擴大或集中市場需求，最終實現市場力量之維持或強化。鑑於獨占事業之行為可能對市場產生重大影響，且忠誠折扣可能同時產生促進競爭與反競爭效果，如何精準而明快地評估忠誠折扣之違法性乃是競爭法之一大難題。在Intel案之前，歐盟競爭法有關忠誠折扣之分析方法存在割裂，即「基於形式的檢視法」與「基於效果的檢視法」。前者起源於歐盟競爭法之早期案件，形成一套穩定維持的實務見解，後者則起源於執委會於2009年發布之《關於執委會就獨占事業之濫用

Mass withholding of their labor from plantations, insistence on their right to reject fulltime wage labor, fighting to regain control over their bodies in production and reproduction both, New Afrikan women in particular cracked the old plantation system. The compromise they forced on the planter capitalists, even within the larger setback for liberation during the fall of Black Reconstruction, was the semi-feudal sharecropping system. 在臺灣，發生醫療爭議可透過法院提起訴訟，也可以訴訟外解決機制處理，相較於醫療訴訟以業務過失致死或重傷害提起告訴，使醫病關係更緊張對立，各縣市衛生局的醫療爭議調處是一個大部分民眾可接受且願意提出申請的管道之一。事實上，依據衛生福利部醫事審議委員會之統計結果顯示，歷年接受委託鑑定之醫療訴訟案，約八成為刑事案件，而逾八成之鑑定結果並無醫療疏失，另醫療法第99條規定的醫事審議委員會任務，是讓各縣市衛生局可受理並進行醫療爭議之醫療調處。近年來，針對醫療爭議或糾紛，無論訴訟或ADR，人民以之為救濟手段之接受程度與行使意願皆有上升趨勢，也奠定臺灣醫療爭議或糾紛救濟管道，訴訟與ADR制度並行之「雙軌制」基礎

。各縣市衛生局辦理醫療爭議調處，程序是由病方透過書面向醫療院所所在之縣市衛生局申請調處開始，後續由衛生局提供一平台讓兩造當事人進行溝通，此管道雖無法直接判定醫療疏失否，但可藉由調處過程由委員們擷取雙方陳述重點，判斷醫病間說法有無異同或矛盾，後續透過委員居中協調，希望雙方有其共識調處能成立。目前各縣市的調處成立率與台中市的數據皆平均約3成左右，影響調處成立與否因素眾多，社會及醫界等仍須努力。有鑒於醫療爭議發生的原因很多，民眾動輒提起民、刑事訴訟，醫病關係難以和諧；而臺中市衛生局過去參與辦理「多元雙向醫療爭議調處機制試辦計畫」經驗，以及對衛生福利部多次推動醫療事故預防及爭議處理法草案的內容有所了解

後，希望未來如果該草案正式通過，能真正消弭爭議，使醫、病及行政機關三方能三贏。此外，衛生福利部應針對法案通過後有其配套措施，諸如醫師及律師公會推薦有意願參加醫療爭議調解會的委員，並辦理調解委員的教育訓練；另外，衛生福利部應與司法院、法務部針對各地方政府衛生局與法院、檢察署有關醫療爭議事件強制移（函）送調解，訂定聯繫作業要點，以供運作之用。
