隨著工業設計產業蓬勃發展，工業產品不再只重視其功能性，更注重其外觀設計。伴隨於此，專利客體亦由專利產品整體外觀，擴及至各部零件之設計。汽車作為日常生活常見的複合式產品，其維修利益龐大，故車廠傾向選擇就汽車之外觀零組件申請專利，除能排除其他競爭者外，亦能鞏固其於售後維修服務市場之地位，使消費者進行維修時僅能使用自家產品，賺取更多利益。我國汽車零組件產業多半從事售後維修服務市場，並於全球零組件市場中獨占鰲頭，年產值驚人。然，我國廠商帝寶公司就車燈產品被提起專利侵權訴訟後，引發國內相關產業恐慌，使我國開始探討設計專利適用維修免責條款之可能，希冀能對於設計專利為限制，保護國內產業以及保障消費者維修權

益。專利法賦予專利權人製造、販賣、使用等行為的排他權，為衡平公益及私益，有諸多就專利權限制的規定。美國法上維修與重建原則認為，若該修理行為屬於維修，為可允許維修；若該修理行為屬於重建，則為法所不允許，構成侵權。如何界定維修與重建之範圍，從而認定其行為的合法性至關重要。不僅我國探討維修免責條款，而欲於專利法中增訂第136條第3項，世界各國亦重視汽車外觀設計的維修議題，部分國家已通過維修免責相關法案。美國作為汽車生產大國之一，於西元2008年起相繼提出限制汽車外觀設計專利的零件法案，惟顧及國內產業利益考量均未通過。作為我國汽車零組件最主要之出口國且其專利法與我國相類，零件法案似能做為我國日後修法時

得參酌之規定。另外，導入維修免責條款影響過大，本文認為比起增訂維修免責條款，使設計專利得適用強制授權較能平衡專利權人保護及消費者權益，且為解決原廠有長期不製造或供不應求的情形，似可考慮恢復舊法第67條及68條未實施及未正當實施之規定。除能保障消費者維修權益，亦能避免單一立法之嫌並得適用於所有複合式產品。
