  在深度學習的研究領域,物件偵測與分類任務一直是該領域中相當熱門的研究子題。為了取得更優良的偵測結果,利用資料擴增法使資料集更具多樣性,使網路模型對測試資料擁有更好的偵測適性,資料擴增法一直是深度學習中相當關鍵的技術。然而,傳統基於影像處理的資料擴增法,除了須花費時間成本在蒐集樣本資料及人工標註,也可能因所擴增之資料太過相似,而降低資料擴增法之效率。再者,不良的人工標註作業也會導致如樣本標註精度不準確或樣本標籤紊亂不一等瑕疵。最終,都可能影響物件偵測與分類任務實驗之偵測結果。本論文提出了一種基於無標記式擴增實境的虛擬資料擴增系統,實驗者可透過GUI設計模組操控虛擬物件以獲取不同的姿態或色溫

,也可透過自動標註模組獲取虛擬物件的邊界框資訊。除了節 省實驗者的時間成本外,因不良的人工標註作業所造成之負面效果也將一併消除。根據實驗結果,對特定類別加入虛擬資料後,除了能提升該類別之偵測結果,整體資料集的mAP也有所提升。此外,本文所提出之虛擬資料擴增系統,與傳統基於影像處理之資料擴增方法比較,提升偵測結果的幅度更為明顯。

隨著工業設計產業蓬勃發展,工業產品不再只重視其功能性,更注重其外觀設計。伴隨於此,專利客體亦由專利產品整體外觀,擴及至各部零件之設計。汽車作為日常生活常見的複合式產品,其維修利益龐大,故車廠傾向選擇就汽車之外觀零組件申請專利,除能排除其他競爭者外,亦能鞏固其於售後維修服務市場之地位,使消費者進行維修時僅能使用自家產品,賺取更多利益。我國汽車零組件產業多半從事售後維修服務市場,並於全球零組件市場中獨占鰲頭,年產值驚人。然,我國廠商帝寶公司就車燈產品被提起專利侵權訴訟後,引發國內相關產業恐慌,使我國開始探討設計專利適用維修免責條款之可能,希冀能對於設計專利為限制,保護國內產業以及保障消費者維修權

益。專利法賦予專利權人製造、販賣、使用等行為的排他權,為衡平公益及私益,有諸多就專利權限制的規定。美國法上維修與重建原則認為,若該修理行為屬於維修,為可允許維修;若該修理行為屬於重建,則為法所不允許,構成侵權。如何界定維修與重建之範圍,從而認定其行為的合法性至關重要。不僅我國探討維修免責條款,而欲於專利法中增訂第136條第3項,世界各國亦重視汽車外觀設計的維修議題,部分國家已通過維修免責相關法案。美國作為汽車生產大國之一,於西元2008年起相繼提出限制汽車外觀設計專利的零件法案,惟顧及國內產業利益考量均未通過。作為我國汽車零組件最主要之出口國且其專利法與我國相類,零件法案似能做為我國日後修法時

得參酌之規定。另外,導入維修免責條款影響過大,本文認為比起增訂維修免責條款,使設計專利得適用強制授權較能平衡專利權人保護及消費者權益,且為解決原廠有長期不製造或供不應求的情形,似可考慮恢復舊法第67條及68條未實施及未正當實施之規定。除能保障消費者維修權益,亦能避免單一立法之嫌並得適用於所有複合式產品。
