近幾年人工智慧又再度成為熱門的討論話題，並運用在我們生活的各個角落， 無論是醫療、量刑、家居、公共衛生等，都佔了一席之地。人工智慧是否最後會 發展得與真正的「人」一樣，目前未可知，但很多電影中都以此作為背景，去探 討相關道德問題。據此，本文並未於此解決相關道德問題，而是針對訓練人工智 慧的資料作為主要討論焦點。即，人工智慧的「學習」，需要透過大量資料不斷 反覆測試、訓練，以確保其所輸出之結果精確。據此，當輸入的資料變成人民的 個人資料時，會產生何種問題，這是本文所好奇的。此外，Facebook 及 Google 在 全世界的高度覆蓋率，並掌握所有用戶，甚至是非用戶的個人資料，以人工智慧 技術

運用在廣告投放中。據此，本文主要以 Facebook 及 Google 在投放廣告行為利 用人工智慧技術之介紹出發，並針對此探討相關的憲法議題及各國針對此有所為 的法律規範，最後回到我國進行相關探討，期能在我國針對此能有相關因應措施。本論文共計六個章節，第一章簡要介紹本論文的研究動機與目的、研究對象 與範圍、研究方法等。第二章分為四大部分，從傳統的廣告形式至線上廣告的發 展，在介紹 Facebook 及 Google 運用機器學習及自然語言處理等人工智慧技術，在 其廣告投放中。本文將其投放廣告行為階段分為三:資料蒐集階段、使用人工智 慧技術進行資料分析階段、透過廣告與廣告受眾進行匹配之投放階段

，分別在該 部分進行介紹。第三章部分為投放廣告行為所產生的憲法議題，主要係針對廣告 商及廣告受眾可能產生憲法所保障的基本權影響。本論文區分為三大部分，即人 工智慧進入投放廣告行為前，廣告所產生的憲法議題。以及人工智慧進入投放廣 告行為後所產生的憲法議題。第三部分，則是介紹劍橋分析事件，強調投放廣告 行為產生之爭議可能產生外溢效果，而導致民主受到影響。第四章以歐盟一般資料保護規則及加州消費者隱私保護法為主要架構，並進 行介紹。歐盟一般資料保護規則針對其立法沿革，並強調其規範重點，如擴大適 用範圍、擴張適用客體、特種個資之新增、相關罰則及具體化當事人同意、強化 當事人權利等。並介紹以歐盟一般資料保

護規則作為依據，對 Facebook、Google 在個人資料蒐集、處理及利用，違反歐盟一般資料保護規則而受到裁罰之案例。 就加州消費者隱私保護法之內容介紹，除規範重點，即適用範圍、適用客體、當 事人權利、通知義務、執法與罰則等規定外，並就可能適用投放廣告行為之條文 規範，及對 Facebook、Google 投放廣告可能產生之影響進行探討。就加州消費者 隱私保護法施行到現在，針對 Facebook 及 Google 違反加州消費者隱私保護法條文 之二案例介紹。此外，針對此二法之異同，分為範圍、定義、資料蒐集合法性基 礎、當事人權利、執法事項等五大部分進行比較。Facebook 及 Googl

e 針對二法之 發布施行，所為之相關因應措施，於第四節中進行介紹。第五章部分即回歸我國個人資料保護法，就立法沿革、目的、個資保護範圍、 原則、當事人權利及罰則等介紹。並比較，我國個資法訂定時所參考歐盟 1995 年 之個人資料保護指令。而 2018 年 GDPR 施行後，許多國家變紛紛效仿，我國立委 亦提出修正草案，本論文針對與現行個資法相異之處進行介紹，並對比與 GDPR 相異之處。據此，提出針對 Facebook 及 Google 投放廣告行為，我國可能可以做出 的回應。第六章即結論，本文認為針對 Facebook 及 Google 運用人工智慧在其投放 廣告行為產生最大的問題就是個人資料

蒐集、利用與處理。據此，在我國涉及資 料使用之法律即為個人資料保護法。雖說立委已經提出修正草案，惟相關規範未 清，且草案尚未通過。而蒐集個人資料之行為是每天不斷發生，若為提早做好規 劃及規範，並有專責機關進行相關執行，人民之隱私將由如在陽光下，不斷被曝 曬著。

本研究利用微波與熱風乾燥技術將香蕉皮、柑橘皮、甘藍菜製備成蔬果粉，探討其理化特性並應用於烘焙食品。實驗結果顯示，微波乾燥蔬果速率顯著優於熱風乾燥。微波乾燥 (0.4 W/g) 約 40至45 分鐘即可達實驗設定之乾燥終點 (水分含量 6%) ；然而熱風乾燥 (50℃、風速 2-3 m/s、乾燥質量與腔室體積比 0.5 g/L) 則約需 3至4 小時才可達乾燥終點。理化性質分析結果顯示，不同乾燥技術會顯著影響 甘藍菜、柑橘皮、成熟香蕉皮製成之乾燥粉末的色澤、總體密度、 膨潤性、 保水性、復水分散度。其中微波乾燥之甘藍菜粉具有最大之總體密度與最佳之膨潤性質與保水性質；熱風乾燥之柑

橘皮與成熟香蕉皮粉則有較佳的復水分散度。可知不同乾燥技術生產之蔬果粉具有不同之加工應用性質。另外，不同乾燥技術生產之蔬果粉具有不同之總酚、類黃酮與膳食纖維含量。微波乾燥製備蔬果粉之可溶性膳食纖維含量高於熱風乾燥製備的蔬果粉，具有更好的加值化應用潛力。將製備的乾燥蔬果粉應用於烘焙食品。感官品評結果顯示用微波乾燥製成富含水溶性膳食纖維的香蕉皮粉以10% 的比例部分取代低筋麵粉製成之餅乾於各項感官指標 (外觀、香氣、風味、口感) 及整體接受度與一般餅乾無顯著差異，具有良好應用潛力。
