隨著科技發展的進步，科技產品研發的技術不斷增長，刑事實務上搜索扣押所取得之證據，已非僅限於傳統實體證據，而是增加許多儲存於電子載體以及雲端等數位環境，是故存載於數位載體及雲端之證據該如何呈現於法庭上，進而法院應如何調查，目前實務上容有許多爭議。數位證據具有易複製性、易竄改性，是以確認偵查中所搜索扣押之數位證據與提示於法院之數位證據，兩者具備同一性及真實性，甚屬重要。而驗真乃證據能力之先決條件，亦即為證據法上之同一性及真實性概念，若未通過驗真之考驗，根本無須檢視是否具有證據能力。我國目前推出司法區塊鏈，乃利用區塊鏈技術之不可竄改之特性，保存偵查時搜索扣押所得之數位證物，以解決目前實務上耗時已久

之驗真程序，確保偵查所得之數位證據即為提出於法院之數位證據。證據能力之判斷，若該數位證據屬供述證據，方須通過傳聞法則之檢驗，然而數位證據究屬供述證據抑或非供述證據，有學者認為應以是否具人之主觀陳述，區分電腦儲存記錄、電腦產生紀錄，前者由使用者所輸出之文字、圖像、符號等人之供述內容之數位檔案，後者為純粹由電腦系統程式，機械性、規律性及經常性所製作的資料，若同時兼具兩者性質者為混合紀錄。數位證據因其人類肉眼不易瞭解性，原則上無法經由勘驗、物證、文書程序進行調查，實務上多藉由刑事訴訟法第165條之1第2項以適當設備顯示後加以調查，惟此種作法是否妥當，有待探討。其中以通訊軟體對話紀錄為例，逕以機器作用

機械性而生成之紀錄，而不具人類主觀陳述內容，將使對話紀錄無法經傳聞法則檢驗，有害於被告反詰問之憲法上權利。

基於分散式帳本技術的P2P檔案分享系統

網際網路儲存方式大致可分為雲端儲存與點對點傳輸，BitTorrent(BT)為點對點傳輸方式的代表。在初始的BT架構，是採用集中式的Tracker紀錄擁有檔案的節點資訊進行傳播，而現今BT網路是各節點維護分散式雜湊表(DHT)儲存節點資訊進行交流。然而集中式Tracker有單點故障疑慮，DHT則會受到女巫、日蝕與汙染等網路攻擊，因此需要一套技術來解決上述問題。有鑑於此，本研究運用IOTA分散式帳本技術實現BT的架構，利用IOTA去中心的特性，BT使用者可於從任何運行IOTA Mainnet查詢到檔案種子節點的資訊，避免單一節點故障造成服務失效。另一方面，利用IOTA Coordicide的自

動對等(Autopeering)和鄰居選擇機制來避免網路攻擊，提高BT的系統安全性。
