　　自動駕駛車的運用已經是世界趨勢，不過在實際上路前，其實還有許多問題亟需解決，最關鍵的莫過於釐清自駕車的法律責任與道德倫理上的難題。在這當中，尤以刑事責任的歸屬問題格外受到矚目。　　要討論自駕車的刑事責任，首先必須為自動駕駛的概念進行定性。客觀上來看，等級3以後的自駕車，明顯與等級0-2自駕車的駕駛系統不同，在評價上應當明確區隔不同的類型與特性。其次，等級3以後的高度自主性自駕車，是否具備承擔刑事責任的能力，是一個討論的重點。即使認定自駕車不可能成為責任主體，其缺乏能力或特性的說明，或許都能轉而成為未來自駕車具備責任能力的條件。　　在使用者與程式設計者的責任上，利用自駕車系統的故意犯罪，似
