從行政任務履行之觀點論行政正確性之法學意義 ──以電網擴建規劃法制為例

2022年3月3日全台大停電事件,使得電網議題成為社會矚目之焦點。由經濟部所提出303停電事故檢討報告尤可看出,在電網過度集中危及電力供應之下,電網擴建或許是我國電力政策之所趨。此不禁令人思考,法制上是否存在什麼樣的制度,能盡可能確保電網擴建以貼合實際需要、減少對第三人與環境之影響、避免人民抗爭、在時間與費用支出上有效率等良善的方式進行規劃?就此,相較於歷來計畫行政法文獻多著重介紹計畫確定制度以及行政計畫之司法審查,國內已有論者強調規劃行政程序在保障當事人權利之外,所具有之取得決策所需資訊、強化行政決定可接受度以及避免後續爭訟之法治意義。此一論述與台、德行政法學界主要針對行政法總論所開啟的行

政法革新研究有異曲同工之妙,蓋因後者乃是以行政任務與正確性為關鍵詞,強調行政法不能僅從個人權利保護之觀點加以理解,尚必須將法學觸角延伸至法院所不能及之無數多面利益衝突關係。基於此一觀察,本文旨在從履行行政任務之觀點,探討規劃法制應如何對公行政規整利益之工作提供框架與指引,以助正確行政計畫之做成;特別是欲以電網擴建規劃為例,觀察德國相關規劃法制所能為我國提供之借鏡。在此一研究問題下,本文將依序探討正確性在行政法學上之意義、行政任務履行觀點下行政法學之面貌,接著從行政法革新研究之脈絡分析規劃法制應有之規整、以德國電網擴建專業規劃法制為借鏡觀察具體之法制設計,而後再檢視我國電網擴建規劃法制、指出其不

在全球國際化和出生率下降的雙重趨勢下,台灣高等教育積極推動EMI(英語為主要的教學媒介),以吸引和增加東南亞國際學生人數。東南亞國際學生在台灣留學時,可能會遇到在新文化中的學業和文化問題。另一方面,本地學生在文藻大學在相同一個跨文化的學習環境中與東南亞國際學生互動。他們也會產生與國際學生類似的困難,因為英語不是他們的母語。本研究的主要目的在於探討和比較東南亞國際學生和本地學生之間不同的學業和文化經驗或困難。本研究採用結構化深度訪談以收集資料。共有十名東南亞國際學生和十名台灣學生接受訪談。此外,U型適應理論、權力距離和個人主義等三種理論被用作本研究的理論架構。結果顯示,東南亞國際學生最大的學術

問題是中文語言障礙,而本地學生面臨的最大挑戰是學術寫作。東南亞學生不適應台灣食物,而本地學生需要適應來自不同文化的東南亞學生。大多數學生採用正向的適應策略來處理他們的學業和文化問題。關於對學術和文化挑戰的適應期,有些與U型曲線理論一致,有些則不同。東南亞和台灣學生都老師表現出比較大的權力距離。東南亞學生逐漸從集體主義轉向個人主義,而台灣學生仍然呈現集體主義特徵。綜上所述,由於研究結果顯示東南亞國際學生可以對本地學生產生正向的影響,因此,將東南亞國際學生和本地國際學生整合在同一個以英語為唯一授課語言的學習環境中,可能是對東南亞國際學生,本地學生,和文藻大學的三贏策略。關鍵字: 高等教育,國際化,
